Key Points (Plain English)

  • Not an emergency service. We do not contact 911 or dispatch help.
  • Alerts may fail. Internet outages, device issues, and email filters/spam controls can delay or prevent delivery.
  • You must have consent. You promise you have permission to add Trusted Contacts and share their details for notices/alerts.
  • We don’t verify relationships. Your contacts may not know you; they can ignore emails or request blocking.
  • User-provided content. Emergency Notes/messages are created by you and are not routinely reviewed before delivery.
  • You are responsible for your safety. Use Demumuu as a secondary tool, not your only safety measure.

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your use of the Demumuu mobile application and related websites or services (collectively, the “Service”). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old (or 16 in certain jurisdictions) to use the Service. By using the Service, you represent that you have the legal capacity to enter into these Terms.

3. The Service

Demumuu is a safety check-in tool. The Service allows you to:

  • Set a check-in schedule (e.g., daily at 9:00 AM).
  • Choose a grace period (e.g., 24 hours after a missed check-in) before an alert is triggered.
  • Add trusted contacts who may receive an automated email alert if you miss a check-in and your grace period expires.
  • Create an optional Emergency Note that is shared only if an alert is triggered.

4. IMPORTANT: Not an Emergency Service

Demumuu does not provide emergency services. We do not contact police, fire, EMS, 911, or other emergency responders.

  • Demumuu is not a medical, mental health, or crisis intervention service.
  • If you are in immediate danger or have a medical emergency, call your local emergency number immediately.
  • Demumuu may not work during outages, low battery, airplane mode, or other technical failures.

5. User Responsibilities

You are responsible for using the Service safely and lawfully. You agree to:

  • Provide accurate information, including your check-in schedule and contact details.
  • Maintain your device, connectivity, and ability to receive and send required app/network communications.
  • Use the Service only for lawful purposes.
  • Not misuse the Service, including for harassment, spam, fraud, or any unlawful activity.

Consent and lawful sharing of contact information

By adding a Trusted Contact, you represent and warrant that you have the right and permission to provide that person’s name and email address to Demumuu for the purpose of sending notices and alerts. You agree not to add people you do not reasonably know or do not have permission to contact.

6. Alerts & Delivery

Demumuu may send automated emails to Trusted Contacts when you miss a check-in and your grace period expires. You acknowledge and agree:

  • Alert delivery is not guaranteed. It depends on third-party providers, networks, and recipient settings.
  • Email delivery may be delayed, filtered, or blocked by email providers, spam controls, or recipient settings.
  • You agree not to rely on Demumuu as your only safety measure.

7. Trusted Contacts: Recipient Options (Blocking & Reports)

Your Trusted Contacts may receive an initial notice that they were added and/or an alert email based on your settings. We do not verify your relationship with any Trusted Contact.

If a recipient does not want to receive future emails, they may contact us at notice@demumuu.com to request blocking (for a specific user or, where applicable, from Demumuu emails generally). We may maintain a minimal record (e.g., email address and block status) to honor such requests.

8. User Content (Emergency Note)

You own the content you create, including any Emergency Note or message. You grant Demumuu a limited license to store and deliver your Emergency Note/message to your Trusted Contacts if an alert is triggered.

You agree not to include unlawful content, threats, harassment, or scams.

Emergency Notes and any other messages are user-provided. Demumuu does not routinely review user-provided content before delivery. You are solely responsible for the content you create and store in the Service, including ensuring it is accurate, lawful, and not misleading or harmful. We may remove, restrict, or take action on content or accounts to address abuse, comply with law, or protect users and recipients.

9. Fees & Payments

Subscriptions or paid features are processed through app stores (Apple/Google) subject to their terms.

10. Intellectual Property

The Service is owned by Demumuu and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service unless we give you written permission.

11. Privacy

Use of Demumuu is governed by our Privacy Policy. Please review it to understand how we collect and use information, including information related to Trusted Contacts and email recipients.

12. Termination

We may suspend or terminate your access to the Service if you violate these Terms or if we believe your use may cause harm to others, violate the law, or compromise the security of the Service.

13. Disclaimers & Limitation of Liability

The Service is provided “AS IS” and “AS AVAILABLE.” To the maximum extent permitted by law:

  • We make no warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement.
  • We do not guarantee uninterrupted or error-free operation, or that alerts will be delivered on time or at all.
  • We do not verify user identities, the accuracy of user-provided information, or the relationship between users and their Trusted Contacts.

To the maximum extent permitted by law, Demumuu is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses arising from or related to your use of the Service.

You agree to indemnify and hold harmless Demumuu from claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your misuse of the Service or violation of these Terms.

14. Governing Law

These Terms are governed by the laws where the Company is established, without regard to conflict of law principles.
